CUSTOMER NOTICE

Effective August 4, 2008, Florida Power & Light Company ("FP&L") increased the rates it charges Orange Tree Utilities Company, Inc. ("Utility"), for electric utility services. Pursuant to Collier County Ordinance No. 96-6, Section 1-6(J), and Rule 5.2 of the Rules of the Collier County Water and Wastewater Authority, Orange Tree is authorized to adjust its rates to account for the increase in the rates it pays FP&L for electricity.

On November 19, 2008, Orange Tree filed its Notice of Intent for Pass-Through Rate Adjustment ("Notice of Intent"), with the Collier County Community Development and Environmental Services Division (CDES) Office of Operations and Regulatory Management to increase water and wastewater rates as a result of this action. The Collier County Water and Wastewater Authority acknowledged and approved the Notice of Intent at its March 23, 2009, meeting, and effective March 1, 2009, the Utility's water rates will increase by approximately 0.59% and wastewater rates will increase by approximately 0.57%.
